-TERMS OF SERVICE-
By commissioning the artist, both parties are now in agreement with the Terms of Service contract. Please read the entirety of the terms before proceeding to avoid any complications with the respective rights of the Artist and Client and the described art within.
I. Usage Rights and Copyright
1. The commissions listed are for non-commercial use only, which means the client may use the artist's work as an avatar icon, header, social media or personal background, or character profile reference so as long as proper credits are shown somewhere visible, whether that’s formatting to keep the artist's watermark visible, listing the artist name, or linking the artist's social media clearly on the page displaying the art.2. The artist retains all rights to the artwork and may publish it in their portfolio. The client is NOT permitted to alter, resell, manufacture for merchandise, or create an NFT of the commission's art, designs, or process under any circumstances. Please email the artist directly for commercial work or works made to gain profits.3. Client shall not reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work, including without limitation, technologies that are capable of generating works in the same style or genre as the Work. Nor shall Client sublicense others to reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work.4. In a case the client does breach the contract of Copyright, the Client, having commissioned the artist, agrees to pay the Artist for any and all claims and expenses resulting from the unauthorized use of the artist's work.
II. Timeline, Process, and Revisions
1. Turnaround time for a single commission can take several weeks to complete or more depending on the complexity and specificity of the client's references and descriptions, communication delays, and the artist's completion of other projects.2. A commission's completion time is subject to change should there be any delays, miscommunications, or sudden events from either party. If so, the Artist is not held liable for any damages that may arise from the Artist's inability to complete the work in a specific or timely manner.3. Clients that have submitted a form will be automatically placed on a wait list until notified otherwise. Accepted client commission requests will be notified by the Artist and the commission process will commence after both parties agree on availability of time and commitment.4. Waitlisted clients could be waiting indefinitely until there's an open slot in the Artist's current queue. The client has the right to withdraw from the waitlist at any point before the start of the commission process.5. The Process:
Once you, the Client, submit a commission form, you will then be added to a wait list. The Artist will review and accept or deny your request and thus notify the Client's availability to start the commission process if the artist accepts the commission.
If accepted and all parties are available, the Client will receive an email from me, the Artist, listing the submitted request and the final price of the commission for the client to confirm.
Once confirmed, the artist will send the client a Paypal invoice for the client to pay in full before the artist starts the process.
After the invoice is paid upfront in full or in the negotiated partial sum, the artist will start reviewing references, clarifying details, and then start on sketches.
The artist will then send the client the first sketch(es) that both parties will refine together to finalize into 1 finalized sketch. The same steps are repeated for colors.
After the client reviews and confirms the finalized design and color sketch, the artist will start the final illustration with several process updates.
The final illustration will be emailed to the client's listed email as a watermarked .jpeg, 300 dpi resolution file(s). Non-watermarked files and .png files are available upon request.
6. Each step of the commission is limited to 3-6 non-major revisions. Any additional changes or revisions to the client-approved sketch during coloring/rendering will have additional fees charged to the client in proportion to the requested change before starting on the changes.
III. Pricing, Refunds, and Termination
1. All Commissions are subjected to a complexity fee reflecting the intricacy of design.2. All commissions are paid through Paypal invoicing only before starting client discussions and art-making.3. Any total below $100 is paid upfront in full. Totals over $100 have the option to negotiate partial separate payments.4. No matter which stage the commission progress is at, the total sum of the commission must be paid in full before the artist starts working on the final illustration.5. The artist retains their right to decline a commission request should there be a reason at any point after accepting a commission whether it's due to a personal emergency, the Client doesn't settle on decisions, or the commission doesn't follow artist guidelines.6. The artist is not obligated to continue a commission if the client fails to settle during the process. Any terminations will be refunded proportionately to the stage at which the work was canceled. Work that has been done by the Artist is non-refundable.
